Table of Contents
1. Statutory Basis
This Statement is made pursuant to the record-keeping and labeling requirements of Title 18, United States Code, Sections 2257 and 2257A, and the implementing regulations at 28 Code of Federal Regulations Part 75.
2. Statement of Compliance
Beyond Media Group ("BMG") complies with the record-keeping requirements of 18 U.S.C. §§2257 and 2257A and 28 CFR Part 75 to the extent such requirements apply to content made available on BeyondFans Creator Studio at pro.beyondfans.ai (the "Service").
3. Scope Clarification — AI-Generated Content
All adult-oriented content generated by and made available through the Service is produced by artificial-intelligence systems. Such content is not a visual depiction of actual sexually explicit conduct by an actual human being within the meaning of 18 U.S.C. §2257(h)(1) and therefore falls outside the record-keeping requirement imposed by that statute on "producers" of such depictions.
Notwithstanding the foregoing, where a Creator uploads reference material depicting, or that may depict, an actual human being and that reference material is used by the Service to produce an Output, BMG voluntarily maintains records equivalent to those required under §2257(b), requires the Creator to attest that the depicted person was (a) at least 18 years of age and (b) had consented in writing to the reference use, and cooperates with lawful inspection as described below.
This clarification reflects BMG's compliance posture based on present law and is not a waiver of any defense or argument available under the statute. BMG reserves the right to update this Statement as law and regulatory interpretation evolve.
4. Custodian of Records
The custodian of records for records maintained in connection with Section 3 is:
[Custodian of Records TBD per 18 U.S.C. §2257(e)]
Beyond Media Group
[Address TBD]
5. Creator Attestation Requirement
Upon any upload of reference material depicting or potentially depicting an actual human being, the Creator must complete an in-Service attestation that (a) the depicted person was at least 18 years of age at the time the reference material was captured, (b) the Creator has obtained and retains a signed written release authorizing use of that person's likeness as reference material for AI generation, and (c) the Creator has retained a copy of a government-issued photo identification of the depicted person. The Creator must produce such records within 10 business days of a written request from BMG.
6. Records Retention
Records maintained under Section 3 are retained for a period of not less than seven (7) years from the date of the last use of the reference material, or for the longer period required by applicable law.
7. Inspection
Records required to be maintained under 18 U.S.C. §2257(c) are available for inspection during normal business hours by the Attorney General of the United States or an authorized designee, upon reasonable notice, at the address of the custodian identified in Section 4.
